Two Jessup teenagers shot apparently accidentally by police during an undercover drug investigation in Jessup in April will not be charged with any crime relating to the incident, their attorneys said this week.

The Howard County state's attorney's office has informed both Garcia Wilson, 15, of Jessup, and Dwayne Usery, 15, of Jessup, that no charges will be filed against them relating to the shooting incident that occurred April 7, their attorneys said this week.

"I think that the state's attorney's office gave a thorough investigation of all the facts and circumstances of the case and felt that after that investigation that charges were not warranted," Jason Shapiro, Usery's attorney, said June 17.

Wayne Kirwan, a spokesman for Howard County State's Attorney Dario Broccolino, declined to comment on the matter because both Usery and Wilson are juveniles.

Wilson and Usery were shot April 7 during an undercover police investigation into drug activity in Jessup, police said at the time. Both teenagers were treated and released from area hospitals.

Charles Jerome Ware, Wilson's attorney, said June 16 that prosecutors wanted to question Wilson as part of their investigation into the shooting, but Ware first demanded and received assurances from prosecutors that his client would not be charged with a crime relating to the April 7 incident.

"I had to get all those assurances before he talks to the state," Ware said.

Shapiro said he was still in discussions with the state's attorney's office about whether his client would cooperate with their investigation.

Kirwan declined to comment specifically on the state's attorney's investigation.

"As a matter of course, the state's attorney's office reviews police involved shootings," he said.

Wilson will meet with prosecutors June 25 to discuss the shooting, Ware said.

The shooting occurred April 7 at about 5:15 p.m. in the 8300 block of Pleasant Chase Road, in Jessup, when the undercover officer, his firearm drawn, stepped out of a car seeking to question the boys, police spokeswoman Sherry Llewellyn said at the time.

The gun apparently accidentally discharged and one bullet struck both boys, Llewellyn said.

Police had observed ''drug activity" in the area prior to attempting to question the boys, Llewellyn said. Police declined to name the officer because he works undercover.

Ware said Wilson had nothing to do with any drug activity in the area.

"They didn't find any drugs on my client and my client wasn't involved in any illegal activity and that includes drugs," Ware said June 16.

Ware also said June 16 that he had filed a Freedom of Information Act request with the Howard County Police Department requesting the results of the department's internal investigation into the shooting. Llewellyn said June 16 that the internal affairs investigation into the shooting has not been completed.
